GENERAL CONDITIONS OF SALE

1. Preamble
These general conditions govern any order placed on the agnesdeverneuil.com website within the framework of a distance selling system, falling under the distance selling regulations described in the Consumer Code and the specific provisions referred to below.

2. Identification of the parties
These conditions of sale apply between:

- The company Agnès de Verneuil, SARL with capital of €10,000 whose registered office is located at 7 rue des Fêtes 75019 Paris (telephone: +33 (0)6 59 47 06 73), SIRET 532 337 755 RCS Paris, publisher of the website agnesdeverneuil.com , hereinafter referred to as “the seller”; and

- Any adult natural person not under guardianship or curatorship wishing to make a purchase via the website “agnesdeverneuil.com”, hereinafter referred to as “the customer”.

3. Purpose
These conditions of sale aim to define the conditions applicable to any purchase made through the seller's agnesdeverneuil.com website.

In accordance with European Directive 2000/31/EC relating to certain aspects of electronic commerce, placing an order constitutes the formation of a contract and constitutes definitive acceptance by the customer of the price and description of the products available for sale as well as all the general terms and conditions of sale.

The seller reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the customer's order.

4. Characteristics of the goods offered
The products offered are those offered on the agnesdeverneuil.com website, while stocks last. Each product is accompanied by a description and care instructions. The photographs are as faithful as possible but cannot guarantee perfect similarity with the product offered, particularly with regard to the colors of the materials. These photographs are not contractually binding, and under no circumstances can the seller be held liable to the customer.

5. Price
The prices displayed are in euros, including all taxes, excluding shipping, packaging, or order processing costs. The seller reserves the right to change its prices at any time, provided, however, that the price shown on the website on the day the order is placed will be the only price applicable to the buyer. The price must be paid in full when ordering.

When ordering products for delivery outside of France, customs duties and formalities are the sole responsibility of the customer, unless otherwise stated. The customer then undertakes to check the import possibilities of the ordered products with regard to the legislation in force in the country of delivery.

6. Order
The customer must identify themselves by completing the order form provided by the seller and follow the instructions provided on the website. The customer is responsible for verifying the contents of their order. Confirmation of the order by the customer constitutes unconditional acceptance of these general terms and conditions of sale and conclusion of the contract.

7. Payment terms
The customer will make payment by the means of his choice:

- By a Paypal account, opening an account is free on www.paypal.fr.

- By credit card: the transaction is carried out through the secure Paypal system. None of the information related to this transaction is visible to the seller or any third party other than Paypal.

- By bank transfer: the transaction is carried out by the customer himself by transferring money from his account to the company's account.

8. Delivery of the order
The ordered product is delivered by post or by an independent carrier, depending on the nature of the product ordered and the option chosen by the customer, to the address provided by the customer at the time of ordering. It is the customer's responsibility to carefully check the address provided at the time of ordering: the seller is not responsible for an incorrect or invalid address for shipping the order.

The seller can ship orders to France and the rest of the world. For countries outside the European Union, delivery is made on a DDU (Delivery Duty Unpaid) basis. The customer will then be required to pay all import or local taxes related to their order.

The order preparation time is 2 to 5 business days following payment of the order, while stocks last. In the event of temporary or permanent unavailability of the products, the seller will inform the customer within 5 business days following payment of the order.

Depending on the delivery address provided by the customer, they will be offered different delivery options:

- Europe or International / Colissimo International: delivery time of 3 to 7 days depending on the destination country. Details of the service on laposte.fr .

Regardless of the delivery method chosen by the customer, the seller reserves the right to choose the transport provider best suited to the context of each sale.

The seller will inform the customer of the tracking number for their shipment. However, the seller declines all responsibility for any delay or delivery problem due to a carrier malfunction. The seller's liability ends as soon as the order is recorded as delivered by the carrier.

The seller cannot be held responsible for any force majeure or for disruptions or total or partial strikes, in particular of postal services and means of transport or communications.

9. Right of withdrawal, exchange and refund
9.1. Right of withdrawal

In accordance with the provisions of the Consumer Code, the customer has a period of fourteen (14) working days from the date of delivery to return the product to the seller for a refund, without penalty except for return costs, unless otherwise indicated by the seller. If this 14-day period normally expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.

The customer will inform the seller in advance of his intention to return the product by email to shop@agnesdeverneuil.com.

9.2. Damage or non-conformity of the product

In the event of damage or non-conformity of the delivery with respect to the order placed, in particular in the event of a size problem for the rings, the customer must formulate his reservations precisely and clearly to the attention of customer service (shop@agnesdeverneuil.com) by indicating the number, date, description and amount of the order. In this regard, it is the customer's responsibility to check the content, conformity and condition of the product upon delivery within a maximum of 48 hours following receipt of the order.

9.3. Conditions required for the return of products

The return of products will only be accepted in compliance with each of the following conditions:

- items must be new, unworn, unwashed, and presented in their original packaging.

- the customer must have indicated their wish to return/exchange the product within 14 days of delivery, by email to shop@agnesdeverneuil.com.

- the customer must have returned the product within 14 days of delivery.

- The Item must be returned in its original packaging, at the customer's expense and risk; by registered mail, in a rigid box so that it is not damaged during transport.

VERY IMPORTANT: Protect the jewelry well during transport, because if it arrives damaged, we will not be able to refund you.

An exchange or refund will be made within 30 days of the seller's receipt of the package. Shipping and return shipping costs in the event of an exchange are not refunded and remain the responsibility of the customer.
No refund or exchange will be made to the customer who has not exercised his right of withdrawal under the conditions of this article.

In the event that the return of the product by the customer is due to an error by the seller (missing product, product not conforming to the order (excluding ring size problem) or manufacturing defect confirmed by the seller subject to the characteristics mentioned in paragraph 4 of these general conditions of sale), the seller undertakes to reimburse, in addition to the purchase price of the product, the shipping costs incurred by the customer for the delivery of the product.

10. Responsibilities
The seller has an obligation of results for all stages of order taking as well as for the stages following the conclusion of the contract.

The seller therefore undertakes to describe the products sold on the Website with the greatest accuracy. However, the seller shall not be liable in the event that the failure to perform its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French case law. Similarly, the seller shall not be liable for any inconvenience or damage inherent in the use of the Internet, including a service outage, external intrusion or the presence of computer viruses.

11. Intellectual Property
All elements of the website www.agnesdeverneuil.com are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio.

12. Private Information
All information collected by the seller is collected in order to process orders and keep the customer informed of the seller's business activities. The seller undertakes not to disclose this information to third parties. In accordance with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the customer has the right to rectify, consult, modify and delete data concerning him. 13. Dispute Resolution
These online sales conditions are subject to French law. Any dispute shall fall under the jurisdiction of the Paris Court.
